Welcome to TrueFixR, a pay-as-you-go storm and hazard data API operated by TrueFixR LLC ("we," "our," or "us"). These Terms of Service govern your access to and use of our website, tools, and services. By creating an account, using an API key, or paying for a request with x402, you agree to these Terms.

1. OVERVIEW OF SERVICES

TrueFixR provides address-level storm history, forecast risk and hazard data through a Data API and an MCP server, billed pay as you go from a prepaid balance. Our platform delivers address-level storm intelligence, not personal homeowner data, and is intended solely for commercial use by businesses.

2. DATA SOURCES

Storm event data and property address data are compiled from public and licensed data sources and matched to each other by location. Reported and radar-detected storm events are presented as received from the reporting sources, and TrueFixR does not alter or fabricate them. Forecasts, weather estimates, risk grades and property values are model outputs: they describe what could happen, not what will happen. TrueFixR is not affiliated with any government weather agency.

3. IMPORTANT DISCLAIMERS

• Storm Records: A storm record indicates a property address is located near a reported or radar-detected storm event. This does NOT indicate damage. All records require physical inspection.
• Property Risk Data: Peril grades and property data are derived from modeled estimates. They are for informational purposes only and do not constitute insurance underwriting or guarantee future storm activity.

4. ELIGIBILITY

You must be at least 18 years old, have the legal authority to enter binding contracts, and use the platform only for lawful business purposes. We reserve the right to request proof of identity or business affiliation.

5. ACCOUNTS, API KEYS AND X402

To use an API key you must create an account and provide accurate information. Paying per request with x402 needs no account, and these Terms apply to that use as well. You are responsible for maintaining the security of your login credentials and agree not to share your account. Each account is for a single user unless explicitly authorized by TrueFixR.

6. PREPAID BALANCE & BILLING

Paid API usage with an API key is billed pay as you go from a prepaid balance that you top up via Stripe. The minimum top-up is $25. Paid requests made with x402 are paid per request, in USDC, at the price returned with the request. There is no subscription and no contract. All payments are final and non-refundable, regardless of the reason. Prices may change at any time in our sole discretion, effective upon posting. Section 12 sets out how API usage is priced and deducted.

7. ACCEPTABLE USE

You agree not to use TrueFixR to scrape or bulk-copy our websites, resell or redistribute data as a competing product, attempt to reverse engineer the platform, or violate any applicable law. Reasonable automated use of the Data API and MCP server is allowed as set out in Section 14. We reserve the right to suspend accounts that violate these terms.

8. INTELLECTUAL PROPERTY

All platform code, design, and non-public data compilations are owned by TrueFixR LLC. Storm and address data originates from public datasets and remains subject to their respective public licenses.

9. LIMITATION OF LIABILITY

TrueFixR is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any warranties of merchantability or fitness for a particular purpose. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including missed opportunities, lost profits, or data inaccuracies. To the maximum extent permitted by law, our total aggregate liability for any claim arising from these Terms or the platform shall not exceed the total amount you paid to TrueFixR in the three (3) months immediately preceding the event giving rise to the claim.

10. AI TOOLS AND CHATBOT

TrueFixR offers an AI-powered on-site chatbot assistant. By using this tool, you agree to the following:

• AI-Generated Content: Responses from the chatbot are generated by artificial intelligence and may not always be accurate. AI output is for informational purposes only and should not replace professional judgment, physical inspections, or expert advice.
• No Guarantees: We do not guarantee the accuracy, completeness, or reliability of any AI-generated response. Use AI outputs as a starting point, not a final determination.
• Usage Limits: AI tools are subject to rate limits and fair use policies. Excessive use of the chatbot may result in temporary or permanent restriction of access. Automated use of the Data API is covered by Section 14.
• Prohibited Use: You may not use AI tools to generate misleading claims, fabricate damage reports, or produce content intended to deceive homeowners, insurance companies, or any third party.

11. DATA API AND MCP SERVER

We provide a Data API (data.truefixr.com) and an MCP server (mcp.atlasunited.io) that let software and AI assistants retrieve our storm and forecast data. Free previews (such as counts, storm types, severities, risk grades and property exposure) are available without an account. Address-level records require either an API key with a prepaid balance or an x402 payment per request, which needs no account.

12. API ACCOUNTS, KEYS AND PRICING

• Address-level records are billed at the price shown on our API page at the time of the request (currently $0.05 per address returned for ML Storm Forecast by Address and for Past Storm Leads by Address: Reported and Radar-Detected, Last 365 Days; $0.05 per event line for Storm History by Address: Reported and Radar-Detected Events Since 2003, with a $10 minimum per report; and $0.0002 per call for the full-detail answers of Model-Based Weather by Address and Model-Based Hourly Forecast by Address), deducted from your prepaid balance or paid per request with x402. Free previews show the estimated cost before you pull.
• Keep your API key confidential. You are responsible for all usage under your key. If it is exposed, rotate it immediately from the API account page.
• An identical request repeated within a short caching window (about 2 hours) may be served from cache without an additional charge.
• Auto-reload is off unless you tick it when you add money. If you turn it on, you authorize us to charge your saved card the same amount as your original deposit whenever your balance falls below $5, no more than once every 20 hours. Email us to turn it off.
• Prepaid balances and charges are final and non-refundable, except where required by law. We may change prices going forward; changes do not affect balance already used.

13. AI ASSISTANTS

When you access our data through a third-party AI assistant, that assistant's own terms also apply. AI assistants may summarize, reformat or misstate our data, and we are not responsible for their output. Check important figures against our API response.

14. AUTOMATED ACCESS, RATE LIMITS AND ABUSE

Automated requests to the Data API and MCP server are allowed, including by software and AI assistants, on the free previews and on paid pulls. Calls without a key are limited to the per-minute rate published in our API documentation. Calls with a key are subject to fair-use limits that we may adjust to protect the service. If you receive a 429 response, wait before you retry. You may not: scrape or bulk-copy our websites; use free previews to harvest or rebuild address-level records or any dataset in bulk; send requests designed to defeat rate limits, billing or caching (including rotating IP addresses or keys); share or resell API keys; or resell or redistribute address-level records as a competing data product. We may throttle, block or suspend access that does any of this or threatens service stability.

15. DATA ACCURACY AND LIMITATIONS

While TrueFixR processes data from public and licensed data sources, we cannot guarantee that all data is complete, current, or error-free.

• Storm event data may contain reporting delays, geographic inaccuracies, or classification errors originating from the reporting sources.
• Address matching is probabilistic. A property appearing in storm results does not confirm it was directly impacted.
• Historical data coverage varies by region and time period. Some counties may have limited or no records for certain event types.

You are solely responsible for verifying all data through physical inspection before making business decisions, providing quotes, or filing claims.

16. INDEMNIFICATION

You agree to indemnify and hold harmless TrueFixR LLC, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, violation of these Terms, or infringement of any third-party rights.

17. GOVERNING LAW

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or your use of TrueFixR shall be resolved exclusively in the state or federal courts located in Texas. You consent to the personal jurisdiction of these courts.

18. TERMINATION

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to access the platform ceases immediately. Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

19. FORCE MAJEURE

TrueFixR shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, government actions, internet outages, third-party service failures, or acts of terrorism.

20. NO GUARANTEE OF RESULTS

TrueFixR provides storm and hazard data as an informational tool only. We do not guarantee that any data, API response, or platform feature will result in a sale, signed contract, insurance claim approval, or any other specific business or financial outcome. You are solely responsible for your own sales, marketing, pricing, and business decisions.

21. DISPUTE RESOLUTION; ARBITRATION; CLASS ACTION WAIVER

Any dispute arising out of or relating to these Terms or your use of the platform shall first be raised with us and an attempt made to resolve it informally within thirty (30) days. If unresolved, the dispute shall be settled by binding arbitration administered under the rules of the American Arbitration Association, conducted in Texas, in lieu of a court proceeding, except that either party may bring an individual claim in small claims court. YOU AND TRUEFIXR EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING AGAINST THE OTHER.

22. SEVERABILITY

If any provision of these Terms is found unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

23. ASSIGNMENT

You may not assign or transfer these Terms, or any rights or obligations under them, without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.

24. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and TrueFixR LLC regarding your use of the platform. Any prior agreements, representations, or understandings are superseded by these Terms.

25. CHANGES TO TERMS

We may update these Terms from time to time. Continued use of the platform after changes constitutes acceptance. We will update the date at the top of this page when changes are made.
